Welcome to the iXperience Website and Student Portal Policy. This policy outlines the terms of use and service that govern all users of the iXperience website and student portal (collectively, "Terms"). These Terms detail the rights, obligations, and limitations of both iXperience Ltd and users when accessing or using our Website and Student Portal.

These Terms were last updated on 1 September 2024 and may be amended at iXperience's discretion. Updates to the Terms will be posted on the Website and/or Student Portal, and it is your responsibility to stay informed of such changes. Continued use of the Website or Student Portal constitutes acceptance of the updated Terms.

Website and Student Portal Usage.

Your access to and use of the Website and Student Portal constitutes your agreement to these Terms, forming a contractual relationship between you and iXperience. If you do not agree to these Terms, you may not access or use the Website or Student Portal.

iXperience reserves the right to:

  • Modify or terminate the Website, Student Portal, or any aspect of the services at its discretion.
  • Deny access to the Website or Student Portal to any user for any reason.

Additional terms may apply to specific services, events, or activities, and will be disclosed in connection with those services. Such terms supplement these Terms and are incorporated herein.

Program and Services.

iXperience offers an academic program that includes educational instruction, cultural tours, accommodation, and related services ("Program"). Successful participants will be required to sign separate documents outlining additional terms governing their participation in the Program.

The use of the Website and Student Portal is strictly for personal, non-commercial purposes, unless otherwise agreed in writing by iXperience.

Relationship Between the Parties.

Your relationship with iXperience is governed by these Terms, as well as any other applicable agreements or policies, including participant terms and conditions. Any use of the Website, Student Portal, or Program is at your own risk.

Subject to your adherence to these Terms, iXperience grants you a personal, non-exclusive, non-assignable, and non-transferable licence to use the content and services available on the Website and Student Portal. Nothing in these Terms grants any licence or right to use iXperience's intellectual property without explicit written permission.

Third-Party Services and Content.

The Website and Student Portal may include content and services provided by third parties. iXperience does not control or endorse such content, and different terms and privacy policies may apply. iXperience is not liable for any products, services, or content offered by third parties.

Account Registration and Responsibilities.

To access certain services, you must register for and maintain an active personal account on the Student Portal.

  • Eligibility: You must between the ages of 18 and 25 years old to register for a Student Portal account. You are solely responsible for the security and confidentiality of your account credentials.
  • Accurate Information: You agree to maintain up-to-date and accurate information in your account. Failure to do so may result in suspension or termination of your access.
  • Account Use: You may not authorise others to use your account or transfer your account to any third party without iXperience's consent. In order to access ypour account, you should of sound mind and have a valid social security number, passport and/or Identity document. Unauthorised use of your account may result in the suspension or termination of services.

Payment of Program Fees.

Upon acceptance into the Program, you are required to pay applicable fees using one of the payment methods available on the Student Portal. Program fees are non-refundable except as provided in iXperience’s distinct Refund Policy. Deposits are final and non-refundable under any circumstances.

In addition to Program fees, you may incur other expenses such as food, medical treatment, or transportation, which are your responsibility and not included in iXperience’s Program fees.

Cancellations and Refunds.

General User Responsibilities and Warranties.

By using the Website and Student Portal, you warrant that you:

  • Will not post or transmit any content that is threatening, harassing, defamatory, or unlawful.
  • Will not interfere with the functionality or security of the Website or Student Portal.
  • Will not infringe on any intellectual property rights.

iXperience reserves the right to terminate or suspend access to users who violate these Terms.

Intellectual Property Rights.

All content, materials, and intellectual property on the Website and Student Portal, including but not limited to text, designs, logos, trademarks, and software, are the property of iXperience or its licensors. You are not authorised to copy, distribute, or modify any intellectual property without iXperience's prior written consent.

iXperience does not guarantee that the Website or Student Portal will be free from errors, viruses, or harmful components. Access to the Website or Student Portal is at your own risk, and you should take necessary precautions to protect your devices.

Indemnification.

You agree to indemnify and hold harmless iXperience, its members, employees, and partners from any claims, damages, or liabilities arising out of your use of the Website, Student Portal, or services.

This indemnity extends to all legal costs incurred in defending such claims and remains in effect after termination of your use of the Website and Student Portal.

Governing Law and Dispute Resolution.

These Terms are governed by the laws of the Republic of South Africa. In the event of a dispute, the parties will attempt to resolve the matter amicably through negotiation. If unresolved, the dispute will be submitted to the Arbitration Foundation of Southern Africa (AFSA) in Cape Town under its expedited rules.

Termination of Access.

iXperience reserves the right to terminate your access to the Website, Student Portal, or services if you violate these Terms. You may also terminate your use by deactivating your account and ceasing access to the platforms. Any liabilities or obligations incurred before termination will survive.

Final Provisions.
